Welcome to our website. These Terms and Conditions outline your rights and responsibilities when purchasing original artwork from us.

By using this website or placing an order, you agree to be bound by these terms. Please read them carefully before making a purchase.

1. Overview

This website sells original artwork to customers in New Zealand and Australia. All artworks listed are one-of-a-kind and sold on a first-come, first-served basis.

2. Our Role as Agent

Rising Creative Studio Ltd represents a number of independent artists and acts as their agent in facilitating sales through this website. While the artwork remains the property of the artist until sold, all transactions, marketing, customer service, storage, packing and delivery are managed by Rising Creative Studio, including coordination with professional third-party logistics partners where applicable.

We are committed to ensuring a seamless and professional experience on behalf of the artists we represent. 

3. Orders

  • Prices are listed in New Zealand Dollars (NZD) by default. However, if browsing from outside New Zealand, you may see prices displayed in your local currency (such as AUD) for convenience. All charges at checkout will be processed in the currency shown at that time and will include any applicable taxes.
  • Orders are subject to availability. In the rare case of a simultaneous sale, we reserve the right to cancel and refund an order.
  • Once payment is received, your order will be processed and dispatched within the stated timeframe.

3. Shipping

We ship to New Zealand and Australia only.

  • Shipping costs are calculated at checkout and charged to the customer.
  • Estimated delivery times are provided but not guaranteed.
  • We are not liable for delays caused by customs, couriers, or other third parties.
  • Customers in Australia are responsible for any import duties or customs fees.

4. Returns and Refunds

We do not accept returns for change of mind.

If your artwork arrives damaged or is lost in transit, contact us within 24 hours of delivery with supporting photos or details. We will assess the issue and offer a resolution, which may include a refund, credit, or replacement (if possible).

5. Artwork Representation

We make every effort to accurately represent each artwork through photographs and descriptions. However:

  • Colours may vary slightly due to screen differences.
  • Sizes are approximate and may vary slightly due to hand-made nature or framing.

Please contact us if you would like additional photos or details before purchasing — we’re happy to help.

6. Copyright and Use

All artworks remain the intellectual property of the artist. Purchasing an artwork grants you ownership of the physical item, not the right to reproduce or use the image commercially.

The artist and this website retain the right to display images of the artwork for promotional or archival purposes.

7. Privacy

8. Website Use

  • You agree not to use this website for any unlawful purpose.
  • We may update, suspend, or restrict parts of the website without notice.
  • All content (including images and text) is protected by copyright and may not be reproduced without permission.
